Nothing in this Agreement limits Company's liability for death or personal injury resulting from Company's gross negligence or wilful misconduct. 13. Indemnification. You agree to indemnify, defend and hold Company, our affiliates, licensors, suppliers, advertisers and sponsors, and our and their directors, officers, employees, consultants, agents and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees) and other expenses that arise directly or indirectly out of or from: (a) your use of or other activities in connection with the Site and/or any Materials; (b) the operation of your business; and/or (c) your breach of this Agreement. 14. Privacy. In order to use certain parts of the Site, you may be asked to supply personal data, which may include, without limitation, your name, email address, and/or other personally identifying information. Clauses 1, 2, 4, 7, 8, 9, 10, 11, 12 and 13, and this Clause 16, shall survive the expiration or termination of this Agreement for any reason. If any provision of this Agreement is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between us relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements or other arrangements between us with respect to such subject matter. Company shall be entitled to assign, transfer or subcontract any or all of its rights, benefits or obligations under this Agreement. You may not, without the written consent of Company, assign or dispose of any or all of your rights, benefits, or obligations under this Agreement. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
